Petition filed under Article 226 of the Constitution of India for the issuance of writ of Certiorari, calling for the records relating to the order of transfer in respect of petitioner Sl.No.2 in the order in No.7/SP(HQ)/TR/2014-38 dated 15.09.2014 on the file of the 2nd respondent quash the same in so far as the petitioner is concerned.

O R D E R

The petitioner challenges the order dated 15.09.2014 on the file of the Superintendent of Police, Headquarters, Puducherry, whereby and where under, he was transferred from Coastal Security, Yanam to Sigma Intelligence.

2. The petitioner is a member of Puducherry Police Service. The matter relating to service in respect of employees of the Government of Puducherry should be filed before the Central Administrative Tribunal. The Tribunal was constituted only for the purpose of disposal of cases relating to Government servants as expeditiously as possible.

3. This Court in Government of Tamilnadu and 2 others v. P.Hepzi Vimala Bai (1994 W.L.R. 698 (FB) and in A.Rajendran and 2 others v. Union of India reported in 1996-1-L.W.470 made it very clear that writ jurisdiction is no longer available for adjudication of cases covered by the provisions of Central Administrative Tribunals Act, 1985.

3. In view of the provisions of Central Administrative Tribunals Act giving jurisdiction to Central Administrative Tribunal to dispose of matters involving service in relation to the employees of Union Territory of Puducherry, the present writ petition is not maintainable before this Court.
