ORDER

The present Writ Petition has been filed seeking a direction to the 4th respondent (Sub Collector (Revenue), Yanam) to dispose of the petitioner's appeal dated 24.09.2025, filed against the Refusal Order dated 16.09.2025 passed by the 5th Respondent, within a time frame as may be fixed by this Hon'ble court after affording due opportunity of hearing to the Petitioner and all concerned parties.

2. Mr.U.Vasanthakumar, learned Additional Government Pleader (P) takes notice on behalf of the respondents 1 to 5.

3. By proceedings dated 16.06.2025, the petitioner was duly selected and appointed to the post of Junior Engineer (Electrical) under the Economically Weaker Section (EWS) category. Pursuant to his selection, the petitioner was due to submit EWS Certificate issued by the competent Revenue Authority at the time of joining and therefore, he applied for issuance of EWS certificate before the 5th respondent on 25.06.2025 along with all necessary documents. After the certificate verification conducted by the appointed authority on 30.06.2025, the petitioner was issued with a Memorandum dated 01.08.2025 granting time till 22.08.2025 for submission of EWS certificate with a condition that failing submission of EWS certificate within the prescribed time would result in cancellation of the petitioner's candidature.

Since, the petitioner's application for issuance of EWS certificate is under consideration and is yet to be disposed of by the revenue authority, the petitioner submitted a representation dated 19.08.2025 to the 3rd respondent seeking extension of time for submission of EWS certificate pursuant to which, an order dated 16.09.2025 came to be passed rejecting the claim of the petitioner seeking extension of time. Challenging the said rejection, the petitioner preferred an appeal before the 4th respondent on 24.09.2025. However, till date, no orders have been passed on the same. Hence, the present Writ Petition has been filed.

5. Learned counsel appearing for the petitioner submitted that, it would suffice, if this Court issues a direction to the 4th respondent to consider and dispose of the petitioner's appeal and pass appropriate orders on the same within the time that may be stipulated by this Court.

6. On the above contention, this Court heard the learned Special Government Pleader (P) appearing for the respondents.

In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the 4th respondent to consider the petitioner's appeal and dispose of the same by passing appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties including the rival claimants, if any.

8. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
