Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus to direct the respondents to consider the claim of the petitioner to fix the salary of the petitioner based on the recommendations of the One Man Committee report as per the Tamil Nadu Revised Scales of Pay Rules, 2009 issued in G.O.Ms.No.338, Finance (Pay Cell) Department dated 26.08.2010 and as per Letter No.63305/Pay Cell/2010-1, Finance (PC) Department dated 8.11.2010 and fix the scale of pay of the petitioner from Rs.5200-20200 + 2600 GP to the scale of pay of Rs.9300 - 34500 + 4200 GP with effect from 01.04.2013 and to disburse the arrears therein, in the light of the representation made by the petitioner dated 23.10.2013 within a reasonable time as deemed by this Court. ORDER
Though the writ petition is filed seeking a positive direction, learned counsel appearing for the petitioner submits that the petitioner would be satisfied if a direction is issued to the 2nd respondent to consider and dispose of the representation made by the https://hcservices.ecourts.gov.in/hcservices/
petitioner in the light of G.O.Ms.No.338, Finance (Pay Cell) Department dated 26.08.2010 and the Letter No.63305/Pay Cell/2010-1, Finance (PC) Department dated 8.11.2010.
2. Heard the learned Special Government Pleader appearing for respondents 1 and 2.
3. Considering the submission made by the learned counsel appearing for the petitioner, a direction is issued to the 2nd respondent to consider the representation dated 23.10.2013 made by the petitioner in the light of G.O.Ms.No.338, Finance (Pay Cell) Department dated 26.08.2010 and the Letter No.63305/Pay Cell/2010-1, Finance (PC) Department dated 8.11.2010. and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
4. The writ petition is disposed of accordingly. However, there is no order as to costs.
