O R D E R

The present criminal original petition has been filed seeking a direction to the respondent Police to secure the accused Umapathy Son of Dhanasingh & Dinesh Pandian Son of Thirumal in Crime No.53 of 2014, pending on the file of the respondent Police, based on the cancellation of anticipatory bail order dated 13.03.2015 in Crl.M.P.No.3720 of 2014 passed by the Principal Sessions Judge, Vellore.

In the petition, it has been stated that the petitioner has lodged a complainant as against three accused persons viz., Dhanasingh, Umapathy and Dinesh Pandian and a case has been registered against the above said persons in Crime No.53 of 2014 for the offences under Sections 294(b), 323 and 506(1) IPC. Thereafter, the accused persons filed a petition for anticipatory bail in Crl.M.P.No.829 of 2014 before the learned https://hcservices.ecourts.gov.in/hcservices/

District Munsif, Ambur and they were granted anticipatory bail. Subsequently, the said anticipatory bail was cancelled on 13.03.2015 in Crl.M.P.No.3720 of 2014 by the learned Principal Sessions Judge, Vellore. Though the anticipatory bail was cancelled on 13.03.2015, till date the respondent police has not taken any steps to secure them. Hence, the petitioner has filed the present petition.

3. Today, when the matter is taken up for consideration, the learned Additional Public Prosecutor submitted that the accused persons viz., Umapathy, S/o. Dhanasingh & Dinesh Pandian, S/o of Thirumal were already granted bail by this Court on 14.10.2015 in Crl.O.P.No.25530 of 2015 and he has produced the copy of the said order.

4. Since, the said Umapathy, S/o. Dhanasingh & Dinesh Pandian, S/o of Thirumal were already granted bail, the prayer that has been made in the present petition has become infructuous.

Hence, the criminal original petition is dismissed.
