O R D E R

(Order of the Court was made by S.M.SUBRAMANIAM,J.,) The Writ of Mandamus has been instituted to direct the respondents to consider the representations dated 07.04.2022 and 09.04.2022 and allocate alternative accommodation in the suitable area as soon as possible.

2. Alternate accommodation to the encroachers cannot be claimed as an absolute right. However, while evicting the encroachers, if the Authorities find that the encroachers are landless poor persons, then they maybe considered for allotment of alternate free house site or tenement as the case may be, based on their eligibility.

3. In this regard the members of the petitioner Association has to submit their applications individually to the competent Authority. If any such applications are received, the eligibility criteria as fixed under the Government Scheme are to be scrupulously followed and if the Schemes are in force, their cases may be considered accordingly.
