This application has been filed by the applicant/plaintiff seeking leave of this Court to sue the respondents/defendants in the above suit.

2. The applicant has filed the present suit seeking injunction restraining the first defendant from releasing the Film namely, Pichaikaran-2 and also for a direction to respondents/defendants to pay a sum of Rs.20,00,000/- towards compensation.

3. According to the applicant, he conceived a story based on the medical development of brain transplantation and approached various cine artists. It was claimed that the defendants copied the original story of the applicant and produced the Film namely, 1/3

Pichaikaran-2 based on the story originally conceived by him. The defendants 1 & 2 are having their office within the territorial limits of this Court. Hence, as per averment of plaintiff a part of cause of action for alleged infringement of copy right had taken place within the territorial limits of this Court. Therefore, this Court is inclined to allow this application.

4. Accordingly, this application is allowed.
