2. The learned counsel for the 2nd respondent submitted that the petitioner is one of the employee against whom the original surcharge proceeding was initiated and thereafter, the surcharge order passed against him has been dropped. Therefore, this writ petition has now become infructuous.

3. In view of the submission made by the learned counsel for the 2nd respondent, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
