O R D E R
This Criminal Original Petition has been filed to direct the second respondent police to register an FIR., on the complaint dated 13.04.2015 preferred by the petitioner.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.
3. It appears that the petitioner's father had sold 1.25 cents of land to the opposite party in the year 1980 and that in the year 2004, the opposite party had settled 1.56 cents i.e., additional 0.31 cents of land. Now, in the year 2015, the petitioner has lodged the present complaint contending that, the opposite party have no https://hcservices.ecourts.gov.in/hcservices/
right over 0.31 cents of land.
4. On a reading of the complaint, the dispute essentially appears to be a title dispute, which could be resolved only by Civil Court. Hence, no positive directions can be issued to the Police to register an FIR., With the above observations, this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
