PRAYER:Writ petition filed under Article 226 of the Constitution of India for issuance of a writ of mandamus to direct the respondents 1 to 3 to conduct survey and fix the boundaries of Survey No.473/24 and 473/25 of Kizhmudhalampedu Village, Gummudipoondi Taluk, Thiruvallur District with the help of police authorities and issue orders of the decisions of Surveyor under Section 10 of Tamil Nadu Survey and Boundaries Act 1923 after giving due notice to the fifth respondent.

The petitioners seek for a mandamus to direct the respondents 1 to 3 to conduct survey and fix the boundaries of Survey No.473/24 and 473/25 of Kizhmudhalampedu Village, Gummudipoondi Taluk, Thiruvallur District with the help of police authorities and issue orders of the decisions of Surveyor under Section 10 of Tamil Nadu Survey and Boundaries Act 1923 after giving due notice to the fifth respondent.
2.After notice, this matter was taken up on 24.10.2017, on which day, there was no representation for the fifth respondent. Again, it is listed today for hearing. Today also, there is no representation for the fifth respondent.
3.The petitioners seek for conducting survey and fixing the boundaries shown at the property mentioned in the petition. The grievance of the petitioners is that the revenue officials are not doing the same, inspite of repeated request made by the petitioners.
4.It is seen that last of the representation was made on 02.01.2017. Therefore, it is for the respondents 2 and 3 to consider the representation of the petitioners and pass orders on the same on merits and in accordance with law, after hearing all the parties concerned including the fifth respondent. Such exercise shall be done by the respondents 2 and 3 within a period of eight weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
