(ii)Stay all further proceedings pursuant to the Judgment and decree award dated 30.01.2020 made in M.C.O.P.No.259 of 2017 on the file of the Motor Accident Claims Tribunal, Special Subordinate Judge, Tiruvannamalai, (in CMP.No.10474/2021)pending disposal of the above CMA.No.1945/2021.
(iii)Stay all further proceedings pursuant to the Judgment and decree award dated 30.01.2020 made in M.C.O.P.No.255 of 2017 on the file of the Motor Accident Claims Tribunal, Special Subordinate Judge, Tiruvannamalai, (in CMP.No.10476/2021) pending disposal of the above CMA.No.1946/2021.
Order : These petitions coming on for orders upon perusing the petition and the respective affidavits filed in support thereof and upon hearing the arguments of M/S.K.J.SIVAKUMAR, Advocate for the petitioner in each the petitions the court made the following order:- Heard the learned counsel for the appellant/Transport Corporation.
2.There shall be an order of interim stay on condition that the petitioner/ appellant/Transport Corporation deposits 50% of the compensation amount, as awarded by the Claims Tribunal, along with interest and costs, to the credit of the MCOP Nos.233, 259 & 255 of 2017, within a period of four weeks from the date of receipt of a copy of this order, failing which, the interim stay granted herein shall stand vacated automatically without any further reference to this Court.
3. Notice to the respondents returnable by four weeks. Private notice is also permitted. The learned counsel for the appellant is permitted to serve notice on the learned counsel, who appeared for the respondents before the Tribunal.
