ORDER
This petition has been filed seeking a direction to the 2nd respondent to remove lock and seal and also handover the possession of the building situated at No.176, Strahans Road, Pattalam, Chennai 600012 forthwith to the petitioner Trust for the benefit of providing free scholarship to the children of the textile workers in Chennai as per the objects mandates under clause 28 of the Bye-laws
of the Madras Labour Union as well as the order of this Honble Court dated 23.04.2012 made in WP.No. 10471 of 2012.
2.The learned counsel for the petitioner would submit that, pursuant to proceedings under Section 145 of the Code of Criminal Procedure, the property situated in Survey No.176, Strahans Road, Pattalam, Chennai 600012, was sealed and locked by the second respondent in the year 2003. Aggrieved by the same, the third respondent filed W.P No.10471 of 2012 before this Court and this Court, by order dated 23.04.2012, dismissed the said writ petition. However, even thereafter, the property sealed by the second respondent has not been handed over to the petitioner's Trust namely Pachaiyappa's Trust. Therefore, the petitioner made a representation on 26.12.2025 to the second respondent requesting him to hand over the key and possession of the said property. However, there was no response from the second respondent. Hence, the present writ petition has been filed.
3.In view of the above, there shall be a direction to the second respondent, if there is no legal impediment, to remove the seal and hand over the property to the petitioner's Trust, within a period of four weeks from the date of receipt of a copy of this order.
4.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
