The Criminal Original Petition has been filed seeking to enlarge the petitioner on bail in Crime No.45 of 2024 registered for the offence under Sections 8(c) r/w 22(C), 25 of Narcotic Drugs and Psychotropic Substances Act, 1985 and Sections 224 & 353 IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence and other than permitting the first accused to use his bank account, he has nothing to do with the alleged offence. He further submitted that there is no recovery from the petitioner/A2. He also submitted that the petitioner is suffering incarceration from 20.01.2024, thereby, he sought for bail to the petitioner.

3. Learned Government Advocate (Crl.Side) appearing for the respondent raised objection for granting bail to the petitioner stating that it is

the case where, 1008 grams of Cocaine (Commercial quantity) were totally seized from the accused. He further submitted that there are 9 accused in this case and the petitioner is arrayed as A2 and the investigation is still pending. He also submitted that two of the accused are still absconding and the accused/petitioner herein is a Nigerian National, therefore, if he is released on bail, there is a possibility that he may abscond and not available for further investigation.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) cases for the respondent and perused the materials available on record including the Counter filed by the respondent Police.

5. Taking into consideration the above facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side), taking note of the fact that two of the accused are still absconding and the investigation is still pending, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 24.04.2024 ham
