C.M.P.No.9542 of 2023 in C.M.A.Sr.No.53670 of 2023 N.MALA, J., This petition has been filed to condone the delay of 132 days in filing the C.M.A.Sr.No.53670 of 2023.
2.It is submitted by the learned counsel for the appellant that the first respondent remained ex-parte before the Tribunal and so notice to the first respondent may be dispensed with and he has also made an endorsement to that effect in the grounds of appeal. Hence, notice to the first respondent is dispensed with.
3.Mr.C.Senthil Kumar, learned counsel takes notice for the second respondent.
4.I have gone through the affidavit filed in support of the petition and I am of the view that the petition may be allowed subject to the condition that the claimant shall not be entitled to interest for the delay period of 132 days. 5.Accordingly, this petition is ordered.
