Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 21.03.2023 within a time frame fixed by this Honourable Court.

O R D E R

The petitioner has filed this Writ petition seeking issuance of a Writ of Mandamus to direct the respondents 1 to 3 to consider and pass orders on the petitioner's representation dated 21.03.2023.

2. Mr.E.Veda Bagath Singh, learned Special Government Pleader takes notice for the respondents 1 to 3. In view of the consent expressed by the Learned counsel on either side, this petition is taken up for final disposal.

3. Since no adverse order is being passed against the 4th respondent, notice to the private respondent is dispensed with.

4. The case of the petitioner is that the petitioner's husband borrowed a sum of Rs.18,000/- from the 4th respondent in the year 2010. Since the petitioner is poor and doing coolie works to meet her day to day needs, the petitioner is unable to repay the said amount. While so, when the petitioner was in Chennai, the 4th respondent broke into the petitioner's house and locked the same, preventing the petitioner from residing in her own house. 2/6

Therefore, the petitioner made a complaint dated 21.03.2023 before the respondents 1 to 3 seeking to recover the possession of the petitioner's house and and hand over the same to her, however, till date no action has been initiated by the official respondents. Hence, this Writ petition.

5. Though very many grounds have been raised, learned counsel for the petitioner submits that, it would suffice, if this Court issues direction to the 2nd respondent to consider the petitioner's representation/complaint dated 21.03.2023 and pass orders on the same as expeditiously as possible.

6. Learned Special Government Pleader has no serious objection for the said order being passed.

7. Considering the limited request made by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the 2nd respondent to consider the petitioner's complaint/ representation dated 21.03.2023 on merits and in accordance with law and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order, after affording an opportunity of personal 3/6

hearing to the petitioner and the private respondent.

8. This Writ petition is accordingly disposed of. No costs. Consequently, connected Miscellaneous petition is closed. 25.04.2023 skt Speaking Order : Yes/ No Index : Yes/ No To 1.
