PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 5th respondent to register the Sale deed presented by the petitioner in respect of lands of an extent of 424 sq.ft comprised in Survey No.161/1 in Thalambur Village, Thiruporur Taluk, Kancheepuram District dated 04.10.2019.

Mr.P.Kumaresan, Additional Advocate General Assisted by Mr.T.Arunkumar, Additional Government Pleader [R1 to R5] Order [Order of the Court was made by S.M.SUBRAMANIAM, J.] This writ petition has been filed seeking a direction to direct the 5th respondent to register the Sale Agreement dated 04.10.2019 entered into between the petitioners and 6th respondent. The present writ is necessitated due to the fact that when the above mentioned agreements were sought to be 2/5

registered, the same was stopped by the 5th respondent on account of the patta over survey number 161/1 in favour of the 6th respondent has been blocked. The petitioners submit that they have invested huge amounts of money into the project and are now left in a limbo due to the arbitrary and illegal actions of the 5th respondent who has refused to register the Construction Agreement and Sale Agreements respectively.

The learned Additional Advocate General appearing on behalf of the State would submit that the Hon'ble First Bench of this Court passed an order constituting a Committee to conduct a survey of the subject property in Thazhambur Village, Chengalpattu District and that the Committee has undertaken the process of identifying the irregularities, illegalities and encroachments etc.,

Since a Committee has already been constituted and has initiated action to conduct the survey and for further actions, no adjudication on the grounds raised in the present writ petition needs to be undertaken at this stage. The matter is now sub judice before the Hon'ble Supreme Court. Subject to the orders of the Hon'ble Supreme Court, the parties are at liberty to redress their grievance, if any exist in the manner known to law. 3/5
