Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus forbearing the 3rd respondent from interfering with the construction of the building in the property of the petitioner situated at Thiruverkadu Co-operative Nagar, Phase V, Plot No.III B, Numbal Village, Maduravoyal Taluk, Thiruvallur District, comprised of S.F.No.5/24, 6/16, 6/17, 6/18, 6/19, 6/20 admeasuring 1330 sq.ft and New S.F.No.31/36 B vide patta No.5928 except the due process of law.

O R D E R

This Writ Petition has been filed seeking for the issuance of Writ of Mandamus forbearing the respondent police from interfering with the construction of the building in the https://hcservices.ecourts.gov.in/hcservices/

property that was purchased by the petitioner in the Court auction sale.

2.Learned Additional Public Prosecutor, appearing for the respondents, on instructions, submitted that the counter party was claiming the right over the property and this was enquired by the respondent police. Ultimately, the counter party named Mr.Sesha Rao gave an undertaking on 02.04.2022 to the effect that he will not interfere with the construction that is put up by the petitioner.

3.In view of the above development, the apprehension raised by the petitioner no longer survives and there is no occasion for the respondent police to interfere with the construction of the building by the petitioner. Accordingly, this Writ Petition is disposed of. No costs.
