ORDER
The petitioner has filed this writ petition seeking direction to the 2nd respondent to provide adequate police protection, based on the representation dated 20.01.2026 in respect of the property comprised in Survey No.106/2A3, Measuring to an extent of 880 square feet of land, situated at Nathahalli Village, Nallampalli Taluk, Dharmapuri District for fencing the land.
2. The petitioner had sent a representation on 20.01.2026 seeking police protection to put up a fence on his property in Survey No.106/2A3 for 880 sq.ft. Earlier the petitioner had approached this Court in W.P.No.31106 /2025 seeking to survey and demarcate the boundaries of the petitioner's land. According to the petitioner, thereafter Survey was conducted and property was demarcated and the Revenue Authorities had confirmed the petitioner's right over the property. Now, when the petitioner attempted to put up fencing, the adjacent land owner who sold the property to the petitioner is making objections and the petitioner is unable to fence his property. Hence, he seeks police protection.
3. The learned Additional Public Prosecutor submitted that the earlier the petitioner had approached this Court and obtained an order and the property of the petitioner was surveyed and it has been confirmed that the petitioner is the
owner of the property in Survey No.106/2A3. In view of the same, now the respondent police can provide police protection.
4. On perusal of the materials it is seen that the third respondent is objecting to putting up the fence in the petitioner's land. The second respondent shall inform the third respondent about the order of this Court. Unless the third respondent is able to produce any valid document or court order to show that the petitioner has no such right to put up fence in Survey No.106/2A3, the second respondent shall give police protection to the petitioner to put up the fence in Survey No.106/2A3 and the petitioner shall put up the fence within a period of two weeks after the general election i.e. 23.04.2026.
