ORDER

This writ petition has been filed challenging the impugned proceedings of the 3 rd respondent dated 19.02.2025 and for a consequential direction to the rd respondent to issue patta in the name of the petitioner with respect to the subject property claimed to be a grama natham land. 2.Heard Mr.N.Suresh, learned counsel appearing on behalf of the petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing on behalf of respondents 1 to 4.

3.The petitioner is placing reliance upon the title document which is a Settlement Deed dated 28.02.2024 registered as Document No.702 of 2024. The

3/6 petitioner further claimed that a superstructure has been constructed and house tax receipts were also submitted to the 3 rd respondent for payment of property tax.

4.The 3 rd respondent has refused to issue patta in favour of the petitioner on the ground that except the Settlement Deed dated 28.02.2024, there is no other document available in favour of the petitioner. 5.In the considered view of this Court, the petitioner is claiming right over the property on the ground that it was an occupied grama natham land. The learned counsel for the petitioner is also placing reliance upon the latest judgment of this Court in N.S.Krishnamoorthy case in W.P.No.4936 etc, of 2025 dated 26.03.2025.

6.Taking into consideration the facts and circumstances of the case and considering the grounds raised by the petitioner and more particularly considering the order passed in W.P.No.4936 etc, of 2025 dated 26.03.2025, the

4/6 impugned proceedings of the 3 rd respondent dated 19.02.2025, is hereby quashed. The matter is remanded back to the file of the 3 rd respondent and the rd respondent is directed to deal with the application submitted by the petitioner in line with the guidelines given by this Court in W.P.No.4936 etc, of 2025 dated 26.03.2025. Necessary orders shall be passed, within a period of six weeks from the date of receipt of copy of this order. 7.In the result, this writ petition stands allowed with the above directions. No Costs.
