ORDER

This transfer civil miscellaneous petition has been filed to withdraw the case in H.M.O.P.No.73 of 2026 on the file of the Family Court, Dindigul to the Family Court, Chennai.

2.Heard both sides and perused the materials available on record. 3.Learned counsel for the petitioner submits that the respondent is a businessman, he has properties and runs rice mill. He filed a petition in H.M.O.P.No.73 of 2026 before the Family Court, Dindigul. The petitioner is residing with her parents at Royapettah, Chennai and the distance between the petitioner's residence and the Family Court at Dindigul is approximately 426 kilometers. The travel time to reach the Court is about 8 to 9 hours and it is very difficult for her to attend each and every hearing before the Family Court, Dindigul. She further submits that the petitioner is an unemployed and do not have necessary financial strength to attend the Court proceedings and she cannot travel to Family Court, Dindigul without the support of her father or any attender. Therefore, she prays to transfer the case to the Family Court, Chennai. 4.Learned counsel for the respondent is present.

5.I have gone through the affidavit filed in support of the transfer petition as well. I find merit in the submissions made by the learned counsel for the petitioner.

6.Considering the facts and circumstances of the case and the submissions made by the learned counsel for the petitioner, this Court is inclined to transfer the case on the file of the Family Court, Dindigul to the file of the Family Court, Chennai. Accordingly, the case in H.M.O.P.No.73 of 2026 is hereby withdrawn from the file of the Family Court, Dindigul and transferred to the file of the Family Court, Chennai. After receipt of the case papers from the Family Court, Dindigul, the Family Court, Chennai is directed to send a notice to the respondent within four weeks. After due service of notice, the Family Court, Chennai is directed to proceed with the matter in the manner known to law. 7.Considering the nature of avocation of the respondent, this Court is inclined to permit the respondent to appear through the Video Conferencing mode before the Family Court, Chennai. However, it is made clear that the respondent shall appear before the Family Court, Chennai as and when required.

8.With the above directions, this transfer civil miscellaneous petition is allowed. No costs. Consequently, connected civil miscellaneous petition is closed.
