(CR.NO.1229/2020) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify one of the condition imposed by this Honble court vide order dated 30.04.2021 in Crl.OP.No.8321 of 2021 in Cr.No.1229 of 2020 by directing the petitioner shall deposit a sum of Rs.2,00,000/- (Rupees Two lakhs only) through demand draft drawn in favour of the Dean, Rajiv Gandhi Government General Hospital, GH Post Office, 3, Poonamallee High road, Near Chennai Central, Chennai-600 003, to enable the Dean to use the aforesaid amount for the purpose of treating the COVID-19 patients, within a period of two weeks. The Challan/receipt of such a payment shall be produced at the time of executing a bond.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.ANANDHARAJ, Advocate for the petitioner, and of M/S.C.E.PRATAP, Govt. Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- (This case has been heard through video conference) This petition has been filed to modify the order in Crl.OP.No.8321 of 2021 dated 30.04.2021 to deposit a sum of Rs.2,00,000/- through demand draft drawn in favour the Dean, Rajiv Gandhi Government General Hospital, GH Post Office, 3.Poonamalle High Road near Chennai Central, Chennai 600 003, to enable the Dean to use the aforesaid amount for the purpose of treating the Covid-19 patients, within a period of two weeks.

2. The learned counsel for the petitioner submitted that due to https://hcservices.ecourts.gov.in/hcservices/

Covid-19, the petitioner is unable to mobilise funds and prays to reduce the amount imposed by this Court in Crl.O.P.No.8321 of 2021 dated 30.04.2021.

3. On perusal of records it is seen that the petitioner was in possession of 5 tonnes of products in a Eicher lorry, hence this Court directs the petitioner to deposit a sum of Rs.2,00,000/-.

4. In view of the above, this Court is of the opinion that the amount imposed by this Court is just and reasonable and no interference is required. Accordingly, this Criminal Miscellaneous petition is dismissed.
