No. 3350 of 2017 on the file of the Principal Sessions Judge, Kancheepuram District at Chengalpattu in Crime No. 937 of 2017 on the file of Inspector of Police, Pallikaranai Police Station, St.Thomas Mount and consequently to modify the condition imposed on the petitioner in Crl.M.P.No. 3350 of 2017 as to the condition of reporting before the respondent police daily at 10.00 a.m and modify the same to report before any police station or any Judicial Magistrate Court at Tuticorin.

O R D E R

The prayer sought for in the present petition is to set aside the order passed by the Principal District and Sessions Judge, Kancheepuram District at Chengalpattu in Crl.M.P.No.3812 of 2017 in Crl.M.P. No. 3350 of 2017 and consequently to modify the condition imposed on the petitioner in Crl.M.P.No. 3350 of 2017.

2. Heard both sides.

3. I am unable to comprehend as to how, by making the petitioner to report before the Judicial Magistrate, Alandur would prevent him to bring down the chances of absconding lesser.

4. In view of the same, the order passed by the learned Principal District and Sessions Judge, Kancheepuram at Chengalpattu in Crl.MP. No. 3812 of 2017 dated 01.11.2017 is modified to the effect that the petitioner shall report before the Judicial Magistrate No.I, Tuticorin daily at 10.30 A.M instead of reporting before the Judicial Magistrate, Alandur in connection with Crime No. 937 of 2017 on the file of the Inspector of Police, Pallikaranai Police Station, St.Thomas Mount,Chennai and also report before the respondent police as and when required. The other observations made in Crl.MP. No. 3812 of 2017 dated 01.11.2017 shall remain intact. With the above directions, the Criminal Original Petition is modified.
