This criminal original petition has been filed to direct the respondent police, not to harass the petitioner in Crime No.477 of 2015, on the file of the Inspector of Police, Sengam Police Station, Thiruvannamalai District.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. On a complaint given by one Sivakumar, who is the husband of this petitioner, the respondent police have registered a case in Crime No.477 of 2015 under Sections 109 & 366 IPC. The allegation of Sivakumar is that this petitioner has been abducted. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Additional Public Prosecutor submitted that if the petitioner appears before the respondent police, then, the case in crime No.477 of 2015 can be closed, if it is found that this petitioner had not been abducted as alleged by her husband Sivakumar.
5. Mr.S.Ananthanarayanan, learned counsel appearing for the petitioner submitted that the life of this petitioner is in danger, fearing which, she is not prepared to appear before the respondent police.
Under such circumstances, the Inspector of Police, Sengam Police Station, Thiruvannamalai, is directed to go to the residence of the petitioner i.e. Konakuttai Gate, Kariyamangalam Post, Sengam Taluk, Thiruvannamalai District, with a woman Sub Inspector of Police and record the statement of the petitioner, if it is found that she had not been abducted, the case in Crime No.477 of 2015 may be closed.
With the above direction, the criminal original petition is closed.
