The Criminal Appeal arises out of the judgment of acquittal dated 08.03.2006 made in C.C.No.65 of 2003 passed by the file of the Judicial Magistrate, Kothagiri.

2.The learned counsel appearing for the appellant would submit that he is not able to contact the appellant. 3.The appeal is arising out of the judgment of acquittal under Section 138 of Negotiable Instruments Act and the appeal has been filed in the year 2006. The learned counsel appearing for the appellant is not able to contact the appellant. In such circumstances, I am of the view that no purpose will be served in keeping the appeal pending. Hence, this Criminal Appeal is dismissed for non prosecution.
