The prayer sought for in this writ petition is for a mandamus, forbearing the respondent authorities from interfering with the peaceful affairs and activities of indoor and outdoor games and other social activities of the

petitioner/R.K.Recreation Club at Survey No.277/2, Karukanahalli Village, Hosur Main Road, Palacode Taluk, Dharmapuri District, by considering their representation dated 30.07.2018.

2. The learned counsel for the petitioner submitted that the petitioner club is functioning for more than three months and there is no complaint from the public, sequel to the activities of the club and the attitude of the members of the club. While so, the officials of the respondents are interfering with the peaceful functioning of the same. Hence, they submitted a representation dated 30.07.2018 to the respondents. Finding no response on the said representation, the petitioner is before this Court.

3. The learned Special Government Pleader appearing for the respondents submitted that so far, there is no complaint received against the club. As long as the petitioner runs the club in lawful manner, the respondents will not interfere with the club. If the petitioner conducts any betting or games involving chances in the club, the respondents shall take action against the petitioner club. However, the learned Special Government Pleader submitted that the respondents would consider the representation of the petitioner after conducting necessary inspection.

Considering the facts and circumstances of the case and having regard to the submissions so made by the learned counsel on either side, this Court without going into the merits of the case, directs the respondents to consider the representation of the petitioner dated 30.07.2018, after conducting inspection and pass appropriate orders on merits and in accordance with law. The entire exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.
