Respondents PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to consider the claim of the petitioner to allow the daughter of the petitioner Ms.Milashini Gnanasekaran (Passport No.E5689086D) to reach India from Singapore for medical treatment and for education forthwith based on visa granted by Government of India VJ7153350 by consider the representation submitted by the petitioner dated 27.10.2016 within a time frame.

O R D E R

After some elaborate arguments by the learned Central Government Standing counsel appearing for the first respondent has produced a letter wherein it is clearly stated that only due to Look Out Circular pending before the second respondent, they are not able to give the visa and if the look out circular is to be set aside in the manner known to law, they will consider the representation of the petitioner.

2. It is further stated that the second respondent requires necessary application for cancellation of Look Out Circular. The petitioner is directed to file an application seeking cancellation of look out circular and if such application is filed, the second respondent is directed to consider the same in accordance with law and pass orders as early as possible taking into consideration the ground of medical purpose.

3. It is made very clear that the second respondent is directed to consider whether the petitioner is entitled for cancellation of Look Out Circular and pass orders in accordance with law as expeditiously as possible.

4. With the above observation, this writ petition is disposed of. No costs.
