ANAND VENKATESH CRIMINAL MISCELLANEOUS PETITION No.6551 of 2022 IN CRL.R.C.No.629 of 2022 SATHIK BASHA [ PETITIONER ] Vs SENTHILNATHAN [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To Suspend the Sentence of One Year simple imprisonment made under the Judgment dated 10.02.2022 in Crl.A.No.68 of 2021, on the file of Learned Sessions Judge, Special Court for Trial of Cases Registered under SC/ST (POA), Act, Namakka, confirming the conviction and sentence in the Judgment dated 30.03.2021 made in C.C.No.72 of 2018, on the file of Judicial Magistrate Court, Rasipuram, pending disposal of the above Crl.R.C.No.629 of 2022.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.W.CAMYLES GANDHI, Advocate for the petitioner, the court made the following order:- This petition has been filed seeking for to suspend the sentence of one year simple imprisonment made under the judgment dated 10.02.2022 in Crl.A.No.68 of 2021 on the file of the learned Sessions Judge, Special Court for Trial Cases registered under SC/ST(POA), Namakkal confirming the conviction and sentence in the judgment dated 30.03.2021 made in C.C.No.72 of 2018 on the file of the Judicial Magistrate Court, Rasipuram pending disposal of the above Criminal Revision Petition.

2. Taking into consideration the materials available on record and the grounds raised by the petitioner, this Court is inclined to suspend the substantive sentence imposed against the petitioner subject to the following conditions.

(a)To comply with the conditions imposed by this Court in Crl.M.P.No.6550 of 2022, failing which this petition will stand automatically dismissed.

(b)The petitioner shall execute a bond for a sum of Rs.5,000/- (Rupees Five Thousand only) along with one surety for a like sum, and (c)The petitioner shall appear before the learned Judicial Magistrate, Rasipuram on the first working day of every month at 10.30 A.M., pending disposal of this Criminal Revision Case.

3. This Criminal Miscellaneous Petition is disposed of accordingly. Post the Criminal Revision after six weeks. -sd/- 18/05/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
