Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 4th Respondent herein to consider the application of the petitioners for sub division patta transfer dated 12.05.2021 in Application No.2021/0105/06/271156 for their land viz., 0.07 cent (3050 sq.ft.) comprised in Old Survey No.145 (New S.No.145/1A1A, 145/4A and 145/4B) in Chetpet Revenue Village and Taluk, Thiruvannamalai District at the earliest point of time as may be fixed by this Hon'ble Court. O R D E R
(The case has been heard through video conference) The Writ Petition has been filed seeking a direction directing the 4th respondent to consider the application of the petitioners for sub-division patta transfer dated 12.05.2021 at the earliest point of time as may be fixed by this Court.
2. The grievance of the petitioners is that, the petitioners' father one K.Lakshmikanthan had purchased an extent of 47 cents of land in Survey No.145 situated in Chetpet village and thereafter, he has also purchased 15 cents of land in said Survey number, totally an extent of 62 cents. Thereafter, the land in Survey No.145, he has sold 55 cents and only remaining 7 cents was with him. Accordingly, the petitioners have approached the 4th respondent to issue patta in respect of above extent through online on 12.05.2021 and thereafter, another application through online on 19.05.2021. But, so far, their application was not considered and no order has been passed on it. Hence, the present writ petition has been filed by the petitioners.
3. Considering the limited prayer sought in the Writ Petition, without going into the merits of the case, the 4th respondent is directed to consider the petitioners' application and pass suitable orders on merits in accordance with after issuing notice to the petitioners as well as other interested parties, if any, within a period of twelve weeks from the date of receipt of a copy of this order.
