O R D E R

This petition has been filed seeking to enlarge the petitioner on bail, pending trial before the learned Additional District (Fast Track) Court, Mettur, Salem District, in S.C.No.6 of 2017 in Crime No.199 of 2016 on the file of the respondent police. The learned counsel for the petitioner would submit that the earlier petition filed by the petitioner seeking bail was dismissed by this Court on 29.03.2021 and directed the trial Court to conduct trial on day to day basis. Now, due to pandemic, trial could not be conducted on a day to day basis and hence there is no progress in trial. The petitioner is in custody from 16.10.2021. Hence he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that almost all the witnesses were examined and at this stage, if the petitioner is released on bail, there is every chances for him to abscond.

Heard both sides.

It is seen that the case is pending for more than seven years and now the case is the fag end of the stage. There is no change in circumstances to grant bail to the petitioner and the reason stated by the learned counsel for the petitioner cannot be accepted.
