(The Order of the Court was made by The Hon'ble The Chief Justice) The petitioner, Ward Councillor seeks restraint against the 6th respondent from constructing a factory on his land. It is the case of the petitioner that appropriate approval has not been given to 6th respondent. No material has been placed before us to substantiate the position qua the grant of permissions to the 6th respondent and without any initial enquiry, straight away this petition has been filed.
2. We are not inclined to entertain this petition, as framed.
3. At this stage, learned counsel for the petitioner states that the factory has already been constructed and commissioned.
4. The writ petition is thus dismissed, leaving the parties to bear their own costs. Consequently, connected miscellaneous petition is closed.
