This Original Petition has been filed by the petitioner to set aside the arbitral award dated 30.05.2018 made in Arbitration Case No.ACP No.7 of 2017 passed by the sole Arbitrator.

2. On 10.06.2019, the petitioner has given an undertaking before this Court stating that he will pay a sum of Rs.4,00,000/-. Accordingly, this Court was granted time to the petitioner to settle the matter by observing that in the event of failing to pay the amount on or before 24.06.2019, the Application will be dismissed.
3. Today when the matter is taken up for consideration, the learned counsel appearing for the petitioner submitted that despite notice sent to the parties, he has no instructions. The learned counsel for the respondent submitted that the amount has not been paid by the petitioner.
4. In view of the non-compliance of the order dated 10.06.2019, the Application stands dismissed. Accordingly, the Original Petition is dismissed and the award dated 30.05.2018 made in Arbitration Case No.ACP No.7 of 2017 passed by the sole Arbitrator is hereby confirmed. However, there is no order as to costs.
