This Civil Miscellaneous Petition has been preferred by the claimant with the delay of 1527 days in filing the appeal. Both the petitioner and the respondents present.
2. The learned counsel for the petitioner/appellant has contended that the award was passed on 19.09.2014 and due to his illness and continuous treatment for long period, he could not prefer the appeal in time.
3. On the other hand the learned counsel for the respondents contended that the delay of 1527 days on medical ground is without any any medical evidence. The petitioner has preferred this appeal after a very long period, in spite of the findings of the Tribunal that there is no disability as ascertained by the doctor. Hence, this Civil Miscellaneous Petition with regard to the condonation of delay is not supported by any medical evidence .
4. Considering the submissions made by both the counsels, the delay of 1527 days is condoned on payment of cost of Rs.3,000/- (Rupees Three Thousand only) to 'Kaakkum Karangal' (Old age Home) at No.212/54, Amman Kovil Street (near chicken market), Parrys, http://www.judis.nic.in
