PRAYER Writ petition filed under Article 226 of Constitution of India for the issuance of writ of writ of Mandamus directing the respondents to remove the BSNL Cell Tower with all the erections and installations over the piece of land measuring an extent of 400 sq.mts in the petitioners property in Survey No. 64/ 2D1, 64/11, situated at Dhanakondapalli Village Taluk, Vellore District and pass orders.

ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondents to remove the BSNL Cell phone tower and other installations over the property belonging to the petitioner. 2.

The respondents have filed a counter affidavit. They have taken a stand that they had taken the property on lease and ultimately, the petitioner did not renew the lease inspite of repeated requests made by the respondents. They have also undertaken in the counter affidavit that they will vacate the premises within three months and shift the cell phone tower to a different place.

In the considered view of this Court, there is no subsisting lease as on today. The respondents have also sought for some time to shift the Cell Phone Tower to some other property. In view of the same, there shall be a direction to the respondents to remove the cell phone tower from the subject property along with all the other installations and move it to some other place with a period of four weeks from the date of receipt of a copy of this order. 4.

This writ petition is disposed of with the above directions. No costs.
