PRAYER: Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the 1st and 2nd respondents herein to pay the award amount to the petitioners, deducting the part payment of award Rs.56,11,753/- already paid from the total award of Rs.88,42,235/- i.e. the remaining award amount of Rs.32,30,482/- with appropriate interest in accordance with law, as per award in L.A.O.P.No.642 of 1996 dated 01.04.1998 on the file of the Sub Judge, Hosur.

This writ petition has been filed for direction to respondents 1 & 2 to pay award amount of Rs.32,30,482/- out of Rs.88,42,235/-. 2.

Heard the learned counsel appearing on either side and perused all the materials placed before this Court. 2/4

It is seen that the total award amount was deposited in LAOP.No.642 of 1996 on the file of the Sub Court, Hosur. A sum of Rs.56,11,753/- was already paid in favour of respondents 5 to 8. Insofar as the petitioners, they were not paid. Therefore, the petitioners are permitted to withdraw the amount concerned by way of application before the Sub Court, Hosur in LAOP.No.642 of 1996 and the Sub Court, Hosur is directed to permit the petitioners to withdraw the said amount. 4.

With the above direction, this writ petition is disposed of. There shall be no order as to costs.
