PRAYER: Criminal Miscellaneous Petition is filed under Section 482 of Criminal Procedure Code, to relax the conditions imposed upon the petitioner in Crl.O.P.No.7024 of 2020 to report before the Inspector of Police, CBI, ACB, Chennai every Monday at 10.30 a.m., every week for a period of three months.

ORDER

(The case has been heard through video conference) This petition has been filed to relax the conditions imposed upon the petitioner in Crl.O.P.No.7024 of 2020 to report before the Inspector of Police, CBI, ACB, Chennai every Monday at 10.30 a.m., every week for a period of three months.

2. Heard both sides.

3. The learned counsel for the petitioner submits that the petitioner is complying the condition order till date and prays to relax the conditions.

4. The learned Additional Public Prosecutor submits that in the earlier order the petitioner is directed to appear before the respondent police once in a week i.e., on every Monday at 10.30 a.m., for a period of three months and thereafter, as and when https://hcservices.ecourts.gov.in/hcservices/

required for interrogation. He further submits that the petitioner has to comply the earlier order till 22.09.2020. He would submit that investigation is still pending and the presence of the petitioner is essential for investigation. Hence, this petition is liable to be dismissed.

5. In view of the submission made by the learned Additional Public Prosecutor, this Criminal Miscellaneous Petition is dismissed.
