Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus calling for the records of the second respondent herein namely The Controlling Officer and Superintendent of Prisons, Central Prison, Coimbatore 18, relating to the impugned suspension order, bearing no.19705/G4/2023, dated 27.09.2023 quash the same as nonest in the eye of law and consequently, issue suitable direction to the 1st respondent herein to reinstate the petitioner in service Grade - II Warder immediately and forthwith within a time frame that may be stipulated by this Court to treat the period of suspension from the date of suspension to date of reinstatement as one of duty for all purposes with full pay and allowances for the period of suspension undergone by the petitioner in the light of G.O.(Ms).No.81, Human Resources Management (N) Department, dated 04.08.2022.

ORDER

This Writ Petition challenges the order of suspension of the petitioner, dated 27.09.2023.

2. When the matter came up for admission today, Mr.Stalin Abhimanyu, learned Additional Government Pleader for the respondents Nos.1 to 3 would produce the order, dated 23.04.2024, in and by which, it can be seen that the Disciplinary Proceedings have been concluded and the punishment of dismissal from service has already imposed against the petitioner.

3. In view thereof, nothing further survives to be adjudicated in the present Writ Petition. Accordingly, this Writ Petition is dismissed as having become infructuous. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
