Respondent Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondent to disburse the loan facility sought for by the petitioner for his daughter to pursue her degree in BSC Nursing Course at "Dr.John's College of Nursing" affiliated to the Rajiv Gandhi University of Health Sciences, Bangalore, State of Karnataka as per application submitted on 08.9.2014.

ORDER

Heard Mrs. S.Meenakumari, learned counsel for the petitioner and Mr.Murthy, learned Standing Counsel for the respondent Bank. 2.

The petitioner seeks for a direction to grant loan for his daughter to enable her to pursue B.Sc. Nursing Course at John's College of Nursing affiliated to the Rajiv Gandhi University of Health Sciences, Bangalore.

The learned standing counsel for the respondent Bank has raised two objections stating that there is no formal application made by the petitioner for grant of educational loan and that the petitioner has secured admission to the Course under Management https://hcservices.ecourts.gov.in/hcservices/

Quota.

4. So far as the first objection is concerned, the same is sustainable as the petitioner has to approach the Bank and has to submit formal application though an application was submitted on line earlier.

So far as the second objection is concerned, after the observation made by the Hon`ble Division Bench of this Court stating that obtaining the seat under Management Quota is not a bar for getting loan and as the new guidelines framed by the Indian Bank Association also recognised the application filed by the candidates who have secured admission under Management quota, the same cannot be put against the petitioner.

In the light of the above, the writ petition is disposed of directing the petitioner to appear before the respondent Bank along with a copy of this order and all necessary documents and apply in the appropriate format and the respondent Bank is directed to consider the same in accordance with the guidelines formulated for grant of education loan. While doing so, the reasonable fee structure shall also be considered by the respondent Bank. Since the petitioner is pursing her education in Karnataka state, the directions have to be complied with by the respondent Bank within a period of two weeks from the date of appearance of the petitioner before the respondent Bank. No costs. Consequently, connected miscellaneous petition is closed.
