Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 4 to consider and dispose of the petitioner's representation dated 09.03.2026 and consequently direct them to grant to the SSLC qualification obtained by the petitioner's son through the seventh respondent and further direct the respondents 5 and 6 to permit the petitioner's son to continue his studies without any interruption and direct the seventh respondent to pay adequate compensation for causing mental agony caused.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents 1 to 4 to consider and 2/8

dispose of the petitioner's representation dated 09.03.2026 and consequently direct them to grant to the SSLC qualification obtained by the petitioner's son through the seventh respondent and further direct the respondents 5 and 6 to permit the petitioner's son to continue his studies without any interruption and direct the seventh respondent to pay adequate compensation for causing mental agony. 2.The learned counsel appearing for the petitioner submitted that the petitioner's son namely, Y.Jafar Sharieff, completed his 10th standard through the seventh respondent open school and obtained SSLC Mark Sheet from the said institution. Thereafter, he secured admission in the fifth respondent Polytechnic College.

Owing to belated admission, the fifth respondent did not permit him to attend the first semester but allowed him to appear for the subsequent examination. In the meantime, the sixth respondent notified the Board of Examinations under the State Board of Technical Education and Training would commence from 27.03.2026. However, the respondents 5 and 6 refused to issue hall ticket to the petitioner's son questioning the validity of the SSLC Mark Sheet obtained from the seventh respondent thereby preventing him from appearing for the Examination.

3.This Court vide order dated 26.03.2026 in W.P.No.12411 of 2026 issued direction to the respondents 5 and 6 to permit the petitioner's son to appear for the Examination scheduled on 27.03.2026 and to file a report before this Court on or before 02.04.2026 as to whether the Secondary School Leaving Certificate obtained from the seventh respondent School is equivalent to that of the Secondary School Leaving Certificate issued by the State of Tamil Nadu.

4.Pursuant to the order of this Court dated 26.03.2026, the fifth respondent has filed counter affidavit stating that when the fifth respondent approached the seventh respondent, the seventh respondent directed the fifth respondent to approach the Board of Open Schooling and Skill Education, Sikkim. Through email as well as through letter, the fifth respondent approached the Board of Open Schooling and Skill Education, Sikkim, requesting them to issue the genuineness certificate and the fifth respondent received email from 4/8

the Board of Open Schooling and Skill Education, Sikkim, that the certificate produced by the petitioner is genuine. On receipt of the genuineness certificate, the very same was forwarded to the sixth respondent. The fifth respondent is bound by the directions of the sixth respondent and the norms prescribed by the Directorate of Technical Education/ sixth respondent. Therefore, if the sixth respondent, being the competent authority, grants approval or recognizes the petitioner's son's qualification, the fifth respondent has no objection to continue the petitioner's son's education without any interruption. The sixth respondent has filed status affidavit stating that the genuineness of the 10th Standard Mark Sheet issued through the National Institute of Open Schooling (NIOS) has been duly verified with the concerned Authorities and upon such verification, the said Mark Sheet has been found to be genuine.

5.In view of the counter affidavit filed by the fifth respondent and the status affidavit filed by the sixth respondent, this writ petition stands disposed of with direction to the respondents 5 and 6 to allow the petitioner's son to complete his studies by treating the SSLC Mark Sheet obtained from the seventh respondent is equivalent to that of 5/8

the Secondary School Leaving Certificate issued by the State of Tamil Nadu.

6.The writ petition is disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
