OSA No.51 of 2015 The Hon`ble The CHIEF JUSTICE and The Hon`ble Mr Justice M.M.SUNDRESH CHAIRMAN&MANAGING DIRECTOR THE KAMARAJAR PORT LIMITED, P.T.LEE CHENGALVARAYA NAICKER MALIGAI NO.23, RAJAJI SALAI, CHENNAI 1 Vs HCC-VAN OORD ACJ JOINT VENTURE HINCON HOUSE, LBS MARG, VIKHROLI WEST, MUMBAI 400 083 The matter has been placed in Court, at the request of the learned counsel for the appellant, who submits that agreed terms were recorded for disposal of the appeal vide judgment dated 23.2.2015 and to modify to the extent that term No.(i), which states that the appeal is withdrawn, it should be replaced as the appeal is "not pressed".

2. We are of the view that really both are one and the same thing. But, the learned counsel for the appellant has prayed that modification is necessary and the same has not been opposed by the learned counsel for respondent. As it is the consent order, we substitute the word "withdrawn" as "not pressed" qua term No.(i).

3. Judgment be amended, accordingly.
