ORDER
The learned Additional Advocate General had forwarded the proceedings of the Director of Survey and Settlement, Chennai-5, dated 29.01.2026, in Na.Ka.O1/23969/2024 (Ni.A) and the relevant portion of the said proceedings are as follows:

In consonance to the directions of the Hon'ble High Court of Madras, the seniority of Thiru T.Sundararajan Steno Typist was already revised in the post of Assistant, considering the date stipulated by the Hon'ble Court i.e.01.03.1989 by assigning S.no.107A by placing next below the Assistant panel for the year 1988.
13. Further, the Hon'ble Court has ordered to examine whether Tmt. S.K.Fathima would be junior to Thiru T.Sundararajan. In this context, the matter was examined in detail and, it is found that Tmt. S.K.Fathima, appointed as Junior Assistant, joined duty on 16.06.1982 and her name was included in the Assistant panel for the year 1988 since she was fully qualified for the above said panel. Whereas Thiru T.Sundararajan was appointed as Steno-Typist
3/5 and joined duty on 13.01.1984 and his name cannot be included in the Assistant panel for the year 1988 since he was not qualified (not passed DOM on the crucial date i.e. 15.03.1988). The above said factum of ineligibility as to non-possessing the prescribed qualification was observed by the Hon'ble Court in the above said Writ Petition. Hence, Tmt.S.K.Fathima would not be Junior and therefore the question of re-fixation on par with her does not arise.

In strict compliance of the order passed by the Hon'ble High Court of Madras dated:01.09.2023 in WP No.17379 of 2018 as explained above, the petitioner's placement from the post of Steno Typist to Assistant was reckoned as on 01.03.1989 and from the said date, the services of the petitioner was taken into account, as to in which post he would retire as per the order of the Hon'ble High Court of Madras and on examination of the said aspect, by comparing the service details of Thiru T.Sundararajan with the service details of Tmt S.K.Fathima, he retired only as superintendent.
2.The learned counsel for the petitioner however raised a grievance that Tmt.S.K.Fathima whom he contends was the Junior of the petitioner had retired as Joint Director and that the petitioner had retired only as an Assistant. He contends that her service as Assistant was regularised only on 09.06.1989, much after the date of the petitioner herein. But however, the key issue is that the
4/5 petitioner had been promoted to the post of Assistant on and from 01.03.1989, which was the primary direction issued by the Court. If the petitioner has any grievance, the petitioner can take up the issue in the manner known to law. 3.The contempt petition stands closed. Consequently, connected applications are also closed.
