Respondents This Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, to direct the respondents to consider the petitioner for promotion to the post of administration officer as per the Special Absorption Rule 1987 considering the date of regularisation i.e., 25.6.1984 on the base date for fixation of seniority under Rule Tamil Nadu State and Subordinate Service Rules by considering representation dated 16.10.2016 and with all service and other monetary benefits. O R D E R
The grievance of the writ petitioner is that her claim for fixation of inter se seniority has not been considered. In this regard, the writ petitioner has submitted a representation to the respondents on 16.10.2016 and the same is yet to be considered.
2. The learned counsel, appearing on behalf of the writ petitioner, states that though the representation was submitted on 16.10.2016 and the right of fixation of seniority and promotion to the writ petitioner has already been affected, it is necessary to consider the present writ petition.
3. In view of the submissions made by the learned counsel for the writ petitioner, the third respondent is directed to consider the representation submitted by the writ petitioner on 16.10.2016 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose the copy of the representation along with the order passed in this writ petition.
4. Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
