The Miscellaneous Petition has been instituted to suspend the sentence of the petitioner imposed in SC.No.234 of 2015 on 27.01.2020.

PW1, PW2 and PW3 are the eye witnesses. The evidence of the above three witnesses corroborates and they explain about the scene of occurrence. Since the appellant has not made out any prima facie case for granting suspension of sentence, grounds raised in the appeal deserves to be adjudicated during the final hearing.

Accordingly, the Criminal Miscellaneous Petition is dismissed.

List Crl.A.No.493 of 2024 after two weeks.
