A.DAMODARAN, ADDITIONAL PUBLIC PROSECUTOR PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b),323, 353 and 506(i) of I.P.C, in Crime No.136 of 2022, seeks anticipatory bail.

2. Heard both sides.

3. The case of the prosecution is that on 16.04.2022 the de facto complainant who is working in the Electricity Board, on complaint of current cut, went to repair and sought time for repairing, at that time, the petitioner slapped the de facto complainant, attacked and threatened him with dire consequences and thereby, caused injuries to the de facto complainant. Hence, the complaint.

4. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent conditions that may be imposed on him.

5. The learned Additional Public Prosecutor would submit that there are ten previous cases pending against the petitioner and the investigation is pending and that there is no change of circumstances. https://hcservices.ecourts.gov.in/hcservices/

6. Taking into consideration of the bad antecedents on the petitioner and also ten previous cases pending against him, this Court had dismissed the earlier petition filed by the petitioner and that there is no change of circumstances. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
