Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Mandamus, directing the Respondents, especially the First Respondent to re-fix the Petitioner's scale of pay eligible to Grade-II trade posts in the light of the rules framed pursuant to G.O.Ms. No. 234 Finance (pay-cell) department, dated 01.06.2009 & G.O.Ms. No.338 Finance (pay-cell) Department, dated 26.08.2010 making further revision of the scale of pay from Rs.5200-20200+2800 to Rs.9300-34800+4400 GP, as per the Letter No.63305/Pay Cell/2010-1 dated 08.11.2010 and G.O. Ms. No. 325, Finance (pay-cell) Department, dated 22.07.2013 and making the petitioner eligible to draw not only the difference in monetary benefits, but stepping up of his pay-scale, considering the Petitioner's recent /last representation dated 04.11.2015. Mr. A.Vinothraj, Learned Counsel appearing for the Petitioner sates that the Petitioner had collected the case bundle from him earlier with consent for change of vakalat to engage another lawyer and he has made an endorsement to that effect in the court record. It has been informed by the Registry that no one else has entered appearance on behalf of the Petitioner in the matter till date. There does not appear to be any useful purpose being served in keeping the Writ Petition pending indefinitely when the Petitioner is not interested in prosecuting the same.

In the aforesaid circumstances, the Writ Petition is dismissed for non-prosecution. It is made clear that the Petitioner is not precluded from applying for revival of the Writ Petition, if necessary, in accordance with law. No costs.
