Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the second respondent to dispose of the petitioner's statutory appeal under Section 12 of the Tamilnadu Patta Passbook Act, 1983 dated 22.04.2015 within a time frame.

By consent, this Writ Petition is taken up for final disposal.

The petitioner and two others claims to have jointly purchased a plot bearing No.4 to an extent of 2700 sq.ft in S.No.385 subsequently subdivided as 385/1A part in Kalapatti Village, Coimbatore through registered sale deed vide Doc.No.961/2007 dated 08.02.2007, on the file of the Sub Registrar Office, Gandhipuram. Similarly, petitioner and one Arul have jointly purchased another plot bearing No.11 to an extent of 3285 Sq.ft in S.No.385, subsequently subdivided as 385/1A part in Kalapatti Village, Coimbatore through registered sale deed vide Doc.No.5783/2007 dated 23.08.2007 on the file of the Sub Registrar Office, Gandhipuram. The petitioner applied to the third respondent for issuance of patta and a conditional patta was granted on 08.12.2014 in his favour including https://hcservices.ecourts.gov.in/hcservices/

the name of other purchasers also. The petitioner, in this regard, has approached the second respondent for reference of the same and he was advised to file an appeal before the first respondent and accordingly, filed an appeal under Section 12 of the Tamilnadu Patta Passbook Act, 1983 dated 22.04.2015 before the first respondent and since no order has been passed, came forward to file this writ petition.

3. Heard the submissions of the learned counsel appearing for the petitioner and Mr.M.Digvijayapandian, learned Additional Government Pleader, who accepts notice on behalf of the respondents.

4. This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the claim projected by the petitioner, directs the first respondent to consider and dispose of the petitioner's appeal dated 22.04.2015, after putting on notice the persons concerned and pass orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the persons concerned.
