Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to issue separate patta in favour of the Petitioner for the property situated at S.No. 514/2, 10 cents out of 1acre and 07 cents at Thamaraipakkam Village, Ranipet District bound by land of Palani in the South North and West by land of V.Mohan, East of Arni-Arcot.

ORDER

This writ petition is filed for a direction to the respondents to issue separate patta in favour of the Petitioner for the property situated at S.No. 514/2, 10 cents out of 1acre and 07 cents at Thamaraipakkam Village, Ranipet District bound by land of Palani in the South North and West by land of V.Mohan, East of Arni-Arcot.

2. It is the case of the petitioner that he is the owner of the property, however, when he started his constructional activities, the sixth respondent objected the same. Hence, the petitioner approached the second respondent for issuance of patta and the same was rejected vide proceedings dated 12.03.2016. Hence, the petitioner preferred an appeal and the same is pending without consideration. Therefore, this writ petition.

3. Heard learned counsel for the petitioner and the learned Government 2/4

Advocate appearing for the respondents 1 to 5 and perused the materials available on record.

4. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

5. Considering the limited relief sought for in this writ petition, this Court without going into the merits of the case directs the third respondent to dispose of the appeal filed by the petitioner and pass appropriate orders on merits and in accordance with law, after giving notice to any other interested persons. Such exercise shall be completed within a period of two months from the date of receipt of copy of this order.
