ORDER

This petition has been filed to direct the respondent police to register the case against the accused on the complaint dated 23.08.2015.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. It is seen that earlier this petitioner had lodged a complaint, in which, petition enquiry was conducted in CSR No.944 of 2015 and the same was closed on 29.06.2015 on the ground that the petitioner agreed to solve the problem by approaching the Revenue Authorities and CMDA. A copy of the closure report is furnished to the learned counsel for the petitioner, across the bar.

4. It is the grievance of the petitioner that her neighbour has encroached one foot into her property and built a compound wall. After the closure of the earlier complaint, this petitioner has lodged a fresh complaint dated 23.08.2015 making allegations against her neighbour that he called her by her caste name.

5. This Court carefully perused the complaint and found that it does not inspire the confidence of this Court, inasmuch as it is a civil dispute between the neighbour and petitioner which is being blown out of proportion. Hence, no positive direction can be granted to the respondent police as prayed for by the petitioner. https://hcservices.ecourts.gov.in/hcservices/

In view of the above, the criminal original petition is closed with liberty to the petitioner to work out her remedy in the manner known to law.
