By consent of both sides, the Writ Petition is taken up for final disposal at the admission stage itself.
2. This writ petition has been filed for a direction to the third respondent to include 5 cents in the name of the petitioner in patta no.321, pertaining to S.F.No.918/2B, 011 Anthiyur Village, Anthiyur Taluk, Erode District.
3. It is the case of the petitioner that he owns an agricultural land in Survey No.918/2B measuring an extent of 1.58 Acres as per the Patta No.321, 011 of Anthiyur Village, Anthiyur Taluk, Erode District. Originally, the petitioner's father purchased the said land measuring to an extent of 1.63 cents vide sale deed dated 20.04.1967, registered as Doc.No.845/1967, on the file of SRO, Andhiyur. However, in the Revenue records, after re-survey, the ARegister pertaining to S.No.918/2 discloses that the total extent of the concerned survey field is only 0.69.50 Hectares, wherein the said land was subdivided as S.No.918/2A measuring 0.05 cent and S.No.918/2B measuring 1.58 acres. It is the grievance of the petitioner that 5 cents of the land has been included as highways Poramboke, without any notice whatsoever to the petitioner. Hence, in this regard, the petitioner has given a representation and 2/4
the 2nd respondent also directed the 3rd respondent to initiate enquiry. However, no action has been taken. Hence, the present Writ Petition.
4. Heard learned counsel for the petitioner as well as the learned Special Government Pleader appearing for the respondents and perused the materials available on record.
5. Considering the limited relief sought for in this writ petition, there shall be a direction to the third respondent to conduct enquiry in this regard and pass orders on merits within a period of two months from the date of receipt of a copy of this order.
