PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the first respondent to consider the petitioner's representation dated 15.12.2015 and to issue patta after conducting enquiry by the 2nd respondent in respect of genuinenity and veracity of legal entitlement of the petitioner and other surviving legal heirs in respect of the property situated at Survey No.622 of Veerapandi Village, Tiruppur District measuring to an extent of 16.70 acres vide Title Deed NO.759 within a time frame. By consent, this Writ Petition is taken up for final disposal.
2. The learned counsel for the petitioner would submit that the land bearing Survey No.622 of Veerapandi Village, Tiruppur District was under the classification of ryotwari land and as per enquiry conducted by the then Settlement Thasildar-II, Gobichettipalayam, it is now merged with Taluk Office, Tiruppur. Accordingly five members were granted patta in TD No.759 to an extent of 16.70 acres of land bearing Survey No.622 of the said village. The petitioner submitted a representation dated 15.12.2015 to the first respondent praying for issuance of a joint patta and since he has not been https://hcservices.ecourts.gov.in/hcservices/
favoured with any response, came forward to file this writ petition.
3. Heard the submission of the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of the respondents.
4. This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the petitioner's representation dated 15.12.2015, permits the petitioner to give one more representation to the respondents along with the prescribed fee and necessary documents, within a period of three weeks from the date of receipt of copy of this order and on receipt of the same, the first respondent is directed to consider the same for issuance of patta and pass orders in accordance with law within a period of eight weeks thereafter.
5. With the above direction, this writ petition is disposed of. No costs.
