Respondents Petition filed under Article 226 of The Constitution of India praying to issue a writ of mandamus directing the 1st respondent to pass orders relaxing Tamil Nadu Pension Rules, 1978 enabling the petitioner to get equal share of family pension along with the 4th respondent as per the judgment and decree passed in OS.No.3195 of 2011 dated 25.09.2012 and consequently direct the 2nd respondent to pay 50% of monthly family pension to the petitioner within a time frame. Learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition on the ground of the assurance given by the third respondent to the petitioner in their letter dated 30.11.2015. He has also made an endorsement in the petition to that effect.
