The petitioner being aggrieved by the registration of the complaint 1/4
in Crime No.19 of 2024 is before this Court to quash the same on the ground that regarding the alleged incident which took place on 19.03.2023, already police has registered CSR and closed it as a civil dispute. While so, suppressing the fact, one Subramanian has approached the Judicial Magistrate, Thiruchengode and obtained order under Section 156 (3) Cr.P.C., to conduct preliminary enquiry and if there is any cognizable offence case may be registered and final report to be within a time prescribed.

The learned counsel referring the closure report dated 15.08.2023 submitted that while the earlier complaint by Subramanian was investigated and closed as Mistake of Facts, pursuant to the direction of the Judicial Magistrate, FIR in Crime No.19 of 2024 been registered and it is under investigation. If there is no cognizable offence made out in the course of investigation necessary report will be filed before the Judicial Magistrate as per direction.

The respondent police has taken note of the civil dispute pending before the parties and same will be duly considered while taking 2/4
the decision on the complaint.

In view of the above facts, this Court disposed of this Criminal Original Petition directing the respondent police to complete the investigation within a period of six weeks.
